General terms and conditions of participation and contract

These General Terms and Conditions of Participation and Contract apply to all contracts concluded with "Leben im Denken e.V." (hereinafter also referred to as "Provider") for the organisation of seminars, training events and other courses, in particular the so-called annual training (hereinafter also referred to collectively as "Seminars").

§ 1 Content of the contract
The content of the individual seminars and the services that are provided as part of them can be found in the respective seminar description, which is published on our website www.philosophie-der-freiheit.de Accompanying seminar documents are issued to participants in paper form and/or sent in electronic form if this is expressly stated in the respective seminar description. If seminar documents are issued and/or sent, this is usually done before or at the start of the seminar.

§ 2 Conclusion of the contract
(1) By submitting your registration via the registration form on our website by clicking on the "Register with obligation to pay" button, you are making a legally binding offer to conclude a seminar contract with

The same applies if you submit the offer in writing or by e-mail to the above address.

We will immediately confirm receipt of your registration via the registration form on our website by e-mail. This does not constitute a binding acceptance of the registration.

(2) A contract with us is concluded when we expressly accept the offer to conclude the contract in writing, by fax or by e-mail to the applicant and the course fee has been paid.

(3) Our contractual partner is the registered participant.

(4) If an introductory interview or letter of motivation is a prerequisite for participation in the course, the contract is only concluded when we finally confirm your acceptance after the successful introductory interview or review of the letter of motivation.

§ 3 Participant fees, due date of payment

(1) Unless otherwise stated, our participation fees include the respective statutory value added tax.

The participation fee for the annual training generally includes the fees for participation, including the boxes with the thought cards, app, internet platform, Zoom conferences, letters, personal support, etc. This does not include face-to-face seminars. Face-to-face seminars are not included and are charged separately, including catering and accommodation costs.

(2) You will receive a separate invoice together with the acceptance of the application to conclude a contract ("confirmation of enrolment").

(3) The invoice amount stated therein is due no later than 10 days after invoicing.

(4) Payment in instalments is possible by arrangement and if a direct debit authorisation has been issued.

§ 4 Right of cancellation

(1) We grant all participants the option of cancelling the contract concluded for a seminar free of charge up to two weeks before the start of the seminar at the latest. In the event of later cancellation, a processing fee of €30 will be charged. Cancellation is no longer possible after the start of the seminar.

(2) Cancellation must be declared in writing or by e-mail. The timeliness of the cancellation is determined by the timely receipt of the cancellation notice by "Leben im Denken" e.V. at the address stated in § 2.

§ 5 Cancellation policy for consumers, consequences of cancellation

(1) If you are a consumer, you also have the right to cancel the seminar contract within fourteen days without giving reasons. The period begins after receipt of this instruction in text form, but not before conclusion of the contract and also not before fulfilment of our information obligations in accordance with Article 246 § 2 in conjunction with § 1 paragraph 1 and 2 EGBGB.
Timely dispatch of the cancellation is sufficient to comply with the cancellation period. An informal message sent by email to us at info@philosophy-of-freedom.org or in writing to "Leben im Denken" e.V. at the address given in § 2 is sufficient for cancellation.

(2) If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.

The costs for returning the work materials shall be borne by the participant. Only sufficiently stamped returns will be accepted.

(3) The right of cancellation shall expire prematurely if the contract has been completely fulfilled by both parties at the express request of the participant before the participant has exercised his/her right of cancellation.

(1) The working documents provided by us are protected by copyright and may not be reproduced or used commercially - not even in part - without our written consent.

(2) If content is made available in digital form (e.g. script documents) (e.g. by e-mail or download), you will only receive a personal right of use, i.e. you will receive the simple, non-transferable right to use the digital content for exclusively personal use in accordance with copyright law in the manner offered in each case. The digital content may be downloaded and printed out once for personal use and copied to your own end devices only. It is not permitted to copy the digital content for third parties, make it publicly accessible or forward it, post it on the Internet or in other networks for a fee or free of charge, imitate it, print it out, sell it on or use it for commercial purposes, or change the content in any way in terms of content or editing or use modified versions. The transfer of online access data to third parties is also not permitted.

(3) The provider accepts no liability for the content of the seminar presentations or the accompanying work documents, unless there is wilful intent or gross negligence on the part of the provider or a vicarious agent of the provider.

§ 7 Special features for online seminars
(1) For online seminars, the recording function is generally deactivated. The fact that the recording function is disabled can be checked at any time in the settings.

As part of the "Annual Philosophy of Freedom Training Programme", some of the video conference calls will be recorded after notification in order to make them available to participants in a password-protected area. Only the active speakers who make a contribution will be recorded, not the group as a whole. It is possible to switch off the camera, in which case only the voice and the name given will be recorded. People who do not speak are not recorded.

Group photos of the "video conference tiles" are also taken on special occasions. These can be published on the homepage, for example.

The recordings and publication can be objected to in text form at any time.

(2) The participants themselves are responsible for fulfilling the technical requirements. Additional costs may be incurred for the internet connection. Whether the PC fulfils the minimum requirements can be tested in advance on our website. The provider accepts no liability for this. A claim for reimbursement in the event of non-functioning technology is excluded.

(3) The access links to the online seminars may not be passed on to third parties or made publicly available. Access is personalised so that it is possible to identify the infringer of this rule. Should the provider become aware that an online seminar is being attended more than once under the same link or that an access link has been made publicly available, the provider shall be entitled to compensation.

(4) The participant undertakes not to use the personal data of other participants, of which he/she may become aware in connection with the online seminar, for commercial purposes or to make it accessible to third parties.

(5) The content of the online seminars is protected by copyright. It is prohibited to take screenshots or video captures during the online seminar. The chat histories are temporarily saved via download.

§ 8 Minimum number of participants and event cancellation
If the minimum number of participants is not reached, the event may be cancelled. Leben im Denken e.V. also reserves the right to cancel events due to force majeure or for other valid reasons. Participants will be notified of such cancellations using the contact details provided in their registration. In such cases, any participation fees already paid will be refunded without deduction. Further claims are excluded.

§ 9 Attestation of participation and certificate
At the request of the participant, a certificate of attendance can be issued upon completion of a seminar.

§ 10 Liability
Leben im Denken e.V. is liable, with the exception of sentence 2, for damages not resulting from injury to life, body or health, only if Leben im Denken e.V., its legal representative or its vicarious agents have caused the damage intentionally or through gross negligence. In the event of a simple negligent breach of material contractual obligations, liability shall be limited to the amount of damage foreseeable at the time of conclusion of the contract and typical for the contract. Essential contractual obligations are those whose fulfilment is essential for the proper execution of the contract, whose breach jeopardises the achievement of the purpose of the contract and on whose compliance the participant may regularly rely.

§ 11 Data protection
